KittiNevi Tours Ltd. is a sea cruise and entertainment company established under the laws of the Federation of St. Kitts and Nevis. We provide exciting sea cruises, sightseeing tours, and marine leisure experiences aboard the M.V. Prince Devonte J., our 96-foot motor catamaran designed to serve cruise ship visitors, hotel guests, residents, and visitors seeking exceptional experiences on the waters of St. Kitts and Nevis.
These Terms & Conditions govern the use of our website and the purchase of tours, cruises, and related services through our online booking system. By making a reservation, purchasing a ticket, or participating in any tour operated by KittiNevi Tours Ltd., you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
1. Definitions
Throughout these Terms:
- Company, we, our, or us refers to KittiNevi Tours Ltd.
- Customer, guest, or you refers to the individual making the booking and every participant included in that booking.
- Website refers to the official KittiNevi Tours Ltd. website.
- Booking means any reservation made through our website or authorized booking channels.
- Tour includes any excursion, sightseeing tour, sea cruise, transportation service, private charter, event, or activity offered by KittiNevi Tours Ltd.
2. Booking Eligibility
By making a booking, you confirm that:
- You are at least eighteen (18) years of age or have the consent of a parent or legal guardian.
- The information provided during booking is complete and accurate.
- You have the authority to make reservations on behalf of every person included within the booking.
The person making the reservation accepts responsibility for all members of the booking.
3. Booking Confirmation
A reservation is considered confirmed only after:
- Payment has been successfully processed;
- A booking confirmation has been issued by KittiNevi Tours Ltd.; and
- An electronic ticket (eTicket) or booking confirmation has been generated.
If payment is declined, reversed, or otherwise unsuccessful, the reservation shall not be confirmed.
4. Prices
All prices displayed on our website are quoted in the currency indicated during checkout.
Prices are subject to change without notice prior to payment confirmation.
Once payment has been successfully completed, the confirmed booking price will not change unless the booking is modified by the customer.
5. Payment
Payment must be made using one of the payment methods offered during checkout.
By submitting payment, you authorize KittiNevi Tours Ltd. and its authorized payment processors to charge the selected payment method for the full booking amount.
KittiNevi Tours Ltd. does not retain complete payment card information on its servers.
6. Booking Modifications
Requests to modify bookings are subject to:
- Availability;
- Operational requirements;
- Applicable administrative charges.
Changes requested within twenty-four (24) hours of the scheduled departure may not be possible.
7. Customer Cancellation Policy
Unless otherwise specified for a particular tour:
- More than seventy-two (72) hours before departure may qualify for a refund, less applicable processing fees.
- Between twenty-four (24) and seventy-two (72) hours before departure may qualify for a partial refund or credit at the Company’s discretion.
- Less than twenty-four (24) hours before departure is generally non-refundable.
- Failure to arrive for a scheduled tour (“No Show”) will result in forfeiture of the booking without refund.
Certain special events, private charters, promotional offers, or holiday cruises may have separate cancellation policies which will be communicated at the time of booking.
8. Company Cancellations
KittiNevi Tours Ltd. reserves the right to postpone, modify, or cancel any tour due to circumstances including but not limited to:
- Severe weather;
- Unsafe sea conditions;
- Mechanical failure;
- Government restrictions;
- Safety concerns;
- Insufficient passenger numbers; or
- Events beyond our reasonable control.
Where appropriate, customers may receive:
- A rescheduled booking;
- Credit toward a future tour; or
- A refund of amounts paid.
9. Check-In & Arrival
Guests should arrive at the designated meeting point no later than the time stated on their booking confirmation.
Late arrivals may result in missed departures.
For safety and operational reasons, vessels cannot be delayed for late-arriving passengers.
Missed departures resulting from late arrival are not eligible for refund.
10. Cruise Ship Guests
Cruise ship passengers are responsible for providing accurate vessel information during booking.
While KittiNevi Tours Ltd. will make every reasonable effort to coordinate tour schedules with cruise arrivals and departures, we are not responsible for itinerary changes, delayed arrivals, early departures, or port closures beyond our control.
11. Health & Fitness
Some excursions require moderate physical activity.
Guests are responsible for ensuring they are medically fit to participate.
Customers should notify us in advance of any medical conditions, mobility limitations, or special assistance requirements.
Participation is undertaken at the guest’s own risk.
12. Safety
The safety of our guests and crew is our highest priority.
Guests must comply with all instructions provided by the Captain, tour guides, and crew members.
KittiNevi Tours Ltd. reserves the right to refuse boarding or remove any person whose conduct places themselves, other guests, or crew members at risk.
No refund will be issued in such circumstances.
13. Children
Children must remain under the supervision of a responsible adult throughout the duration of the tour.
Certain excursions may have age restrictions or safety requirements.
14. Weather Conditions
Tours generally operate in varying weather conditions.
Tours will only be cancelled where weather or sea conditions are considered unsafe by the Captain or management.
Weather conditions alone do not automatically entitle guests to refunds.
15. Electronic Tickets
Our booking system issues electronic tickets that serve as proof of purchase.
Each ticket may contain:
- Booking reference;
- QR Code;
- Guest information;
- Tour details;
- Date and departure time.
Guests may present either a printed copy or the digital ticket on a mobile device.
16. QR Code Validation
Electronic tickets may be validated using our secure QR Code scanning system.
QR Codes are unique and may only be used for the booking for which they were issued.
Duplicate, copied, altered, expired, refunded, or previously scanned tickets may be rejected.
Attempts to fraudulently use electronic tickets may result in refusal of boarding without refund.
17. Personal Property
Guests are responsible for their personal belongings.
KittiNevi Tours Ltd. accepts no responsibility for loss, theft, or damage to personal property brought aboard our vessel.
18. Photography & Media
Photographs and video recordings may be taken during tours for promotional purposes.
By participating, guests consent to the use of their image in marketing materials unless they notify a crew member before departure.
19. Limitation of Liability
Participation in marine tours involves inherent risks.
To the fullest extent permitted by law, KittiNevi Tours Ltd.’s liability shall be limited to the amount paid for the affected booking.
KittiNevi Tours Ltd. shall not be liable for indirect, incidental, consequential, or special damages including but not limited to missed flights, missed cruise departures, accommodation expenses, loss of income, or loss of enjoyment.
20. Force Majeure
KittiNevi Tours Ltd. shall not be liable for delays, cancellations, or failure to perform resulting from circumstances beyond its reasonable control including but not limited to hurricanes, tropical storms, earthquakes, pandemics, civil unrest, government actions, utility failures, transportation disruptions, or other force majeure events.
21. Refund Processing
Approved refunds will be processed using the original payment method wherever possible.
Processing times vary depending upon the customer’s financial institution and payment processor.
22. Fraud Prevention
KittiNevi Tours Ltd. reserves the right to verify customer identity, payment information, and booking details where fraud is suspected.
Fraudulent transactions may be cancelled without notice and reported to the relevant authorities.
23. Privacy
Personal information collected during the booking process is used solely for processing reservations, customer communication, operational purposes, and compliance with applicable laws.
Customer information will not be sold to third parties.
24. Intellectual Property
All website content, photographs, videos, graphics, logos, branding, tour descriptions, booking software, electronic tickets, and QR code technology remain the property of KittiNevi Tours Ltd. or its licensors and may not be reproduced without prior written permission.
25. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Federation of Saint Christopher (St. Kitts) and Nevis.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Courts of Saint Christopher and Nevis.
26. Amendments
KittiNevi Tours Ltd. reserves the right to amend these Terms & Conditions at any time.
The version published on the website at the time a booking is made shall govern that booking.
